Businesswoman Sarah Wairimu Kamotho, also known as Sarah Wairimu Kamotho Cohen, has been charged by the Director of Public Prosecutions (DPP) with giving false information to the police and swearing a false affidavit regarding the alleged loss of her passport.
Appearing before Principal Magistrate Zainab Abdul at the Kibera Law Courts, Wairimu was accused of knowingly providing misleading information to police officers at Munyange Police Station in Othaya, Nyeri County, on February 20, 2023.
According to the prosecution, Wairimu falsely reported to Chief Inspector Mercy Riungu, the Officer Commanding Station (OCS), that her passport had been lost.
Acting on the report, police issued her with a police abstract—a document later found to be based on false information.
In the second count, Wairimu was charged with false swearing, contrary to Section 114 as read with Section 36 of the Penal Code.
The charge sheet stated that on the same day, at Pamki House in Nyeri Town, she appeared before Advocate Muchiri wa Gathoni and swore a false affidavit claiming her passport had been lost, despite knowing that was not true.
The prosecution, led by Samson Ng’etich, told the court that Wairimu’s actions amounted to deliberate deception intended to mislead public officers and interfere with lawful procedures.
Wairimu denied both counts and pleaded not guilty.
The court was informed that she is currently remanded at Lang’ata Women’s Prison, where she is also facing a separate murder trial linked to the death of her husband, Dutch businessman Tob Cohen.
The case has been scheduled for mention at a later date as the prosecution prepares to present evidence and witnesses in support of the charges.
