Detectives have arrested a man suspected of murder in Eastleigh, Nairobi, in an operation that also led to the recovery of a firearm and stolen property.
The suspect, identified as Peter Kimani, alias Kim, was cornered along Gallole Street during a joint operation by detectives from Dandora and Shaurimoyo.
From his possession, officers seized a Retay Falcon pistol, a live 9mm hollow‑point round, and a spent cartridge of similar calibre.
In addition, detectives impounded a red Boxer motorcycle, registration number KMGT 530S, believed to have been stolen.
Kimani is currently in custody as investigators complete processing ahead of his arraignment in court.
Under Section 203 of the Penal Code (Cap. 63), murder is defined as the unlawful killing of a person with malice aforethought. The law prescribes the harshest penalty for those found guilty:
- Section 204 of the Penal Code states: “Any person convicted of murder shall be sentenced to death.”
- Although the death penalty remains in law, Kenya has not carried out executions since the 1980s. In practice, courts often commute death sentences to life imprisonment.
- The distinction between murder and manslaughter is critical: murder requires proof of intent, while manslaughter involves unlawful killing without intent, carrying a lesser penalty.
